New COVID Forms - Need from all clients

 

 

Hi – We have new forms for COVID-19 that we need on all listings and all buyers.  DO NOT show a buyer anything or meet with any customer or client without having them sign one of the forms. Thanks for your help with this.  Watch the video and see below the video for links on the forms.

Please see the email below from Steve Graham, General Counsel for Missouri REALTORS® regarding an update to the Listing Contract COVID-19 Rider/Amendment, that was released last week, and two other new forms, CVID Showing Flyer and COVID-19 Release & Hold Harmless Agreement.  These forms are not available in TransactionDesk yet, but have been uploaded to the MLS Intranet in Flexmls.  They should be available in TransactionDesk soon.

Dear Missouri REALTORS®,

I hope this message finds you well. The Residential Forms & Risk Management Committees have remained quite busy considering your collective input and what additional forms or other tools we are able to provide to assist you in dealing with the COVID-19 pandemic. Last week, we made available Rider/Amendment forms to use for both Sale Contracts (COVID-2001) and Listing Contracts (MSC-1031).

Effective immediately, we are now making available the following:

1. COVID Showing Flyer: This voluntary form is designed to allow for posting on the exterior access doors of a listed property. It asks all persons about to enter a property to confirm they satisfy basic health screening questions (and any other showing terms or protocol an Owner may establish) prior to entry. Obviously, it is impossible to effectively screen or monitor all people with complete assurance, but under current circumstances, it would seem to represent a "reasonable" step that one might take.

2. COVID-19 Release & Hold Harmless Agreement (COVID-2002): This "stand-alone" form can be used in any situation (for Seller, Buyer or Tenant clients & customers) impacted by property access needs or desires in a real estate transaction (both sales & leases). Obviously, continuing such activities (where permitted) involves a certain degree of risk which may result in illness or much worse. This form acknowledges that risk and, in light of the signatory's desire to proceed forward, sets forth their agreement not to sue the REALTOR
® involved on account of any exposure to disease-causing organisms (such as COVID-19).  In other words, it releases the identified REALTOR® (and all of its agents, etc.) from all claims and liability as a result of any such possible exposure).

3. Listing Contract COVID-19 Rider/Amendment (MSC-1031): The initial version released last week has essentially been updated to incorporate the same release concept discussed above.   

Like last week, we will proceed to process these forms and make them available via all of our vendors (per usual), but in order to avoid delay, they are linked within this message and accessible via our Coronavirus Resources page. These are available for your immediate use. We remain committed to providing you with the tools and information needed to navigate these trying times.

Columbia and County Stay at Home Order

Hi Everyone –

 

Below and attached I have included the language from the City which includes Real Estate as an Essential Service.  The REALTOR associations, governments, brokers, attorneys, agents – we are all working on this.  What this means:

 

First and foremost it means that the virus has escalated to a point in our area that we need to continue to take more precautions.  We need a commitment from you as a valued part of this office and community to continue to limit your activities.  Under no circumstance should any agent, professional, seller or buyer be performed to interact if they are uncomfortable.  It is important that you treat all clients equally and offer the same services.

 

It sounds trite, but we are all in this together and we will all see the other side of this, but I want you alive!!  We are doing everything we can to make sure the health of the community is in tact and your business is protected.

BUSINESS OPERATIONS and a step-by-step guide to operating virtually. (All precautions taken in regards to the current and changing CDC guidelines and federal, state, county and local orders and laws):

 

  1. LISTING APPTS:  Listing Appointments should be done virtually. 
    1. Email Pre-Listing Material with Sellers Questionnaire
    2. Look up previous data about the home
    3. Run the comps
    4. Ask them questions about the home. Have they made any changes or additions.
    5. Have them take pictures and send to you.
    6. Have them send you a video of the rooms inside and outside.
    7. Have them fill out a MLS features form in advance so you know what materials etc. are in the home.
    8. Hop on a Zoom/Facetime/Google Hangout/Duo Call/Facebook Messenger/Skype (VIDEO CALL) and talk with them about your services.  Share your desktop and walk them through online marketing samples. Talk them through the forms.
    9. Docusign/Authentisign Forms to clients to sign Listing Paperwork.
    10. Send Chris Jansen or other photography services when no one is in the house.  Limited surfaces need to be touched to film the virtual tour.  Use their photos and touch them up with Box Brownie.  Virtual Stage with Box Brownie or remove clutter in the home. 
    11. Upload the photos in the MLS
    12. Ask Billy for help!!
  2. MARKETING: All marketing can be done virtually
    1. MLS Large Portal Distribution – Realtor.com, Zillow, Trulia
    2. Send out Marketing Announcements with the Design Center
    3. Use www.remaxhustle.com listing videos
    4. Local Egroups and List serves
    5. Social postings on social media sites – Facebook, YouTube, Twitter, Large Portals
    6. Use your database for distribution.
  3. BUYERS PRESENTATIONS:  Showings should be done virtually. 
    1. Email Pre-Meeting Materials with Buyers Questionnaire
    2. Hop on  a Video Call and talk with them about your services.  Share your desktop and walk them through online marketing samples. Talk them through the forms.
    3. Docusign/Authentisign Forms to clients to Sign Buyer's Paperwork
    4. Connect them with a lender for pre-approval.  Applications all done online.
  4. SHOWINGS: Showings should be done virtually.  Only under extreme circumstances in person.
    1. Send links to prospective listings to clients ahead of time within their parameters. .  Use the RE/MAX Website Links or MLS.
    2. Hop on a Video Call.  Share your desktop and walk them through listings.

                                                                                       i.      Have the seller walk them through the house with Video Call.  Screen Share with your buyers.

                                                                                     ii.      Have the seller open all doors and turn on all the lights and leave the house. Only Buyer's Agent walk thru the house and Video Call without touching anything.

                                                                                   iii.      Walk through a vacant house and video call the buyers.

                                                                                   iv.      Offer to perform the showing on your listing for the buyer and buyer's agent for them. We can all work together.

    1. If Sellers are uncomfortable leaving the home, then consult with them about option to ensure CDC best practices. Options could be, but not limited to: go outside, go in another area of the home, stay recommended distancing. 
  1. CONTRACTS WRITING, PRESENTATION and ONGOING NEGOTIATION: Contracts can be done virtually
    1. Write up documents using forms software
    2. Sign Electronically with digital signature software
    3. Use Video Call or screen sharing to talk, go thru the documents with your clients.
    4. Same will happen on the other side.
    5. Clauses available to buy unseen in person, clauses to account for COVID-19 Delays, clauses to account for possession after closing if necessary
  2. INSPECTIONS: In person
    1. Inspections can be set further out based on seller preferences
    2. If Sellers are uncomfortable leaving the home, then consult with them about option to ensure CDC best practices. Options could be, but not limited to: go outside, go in another area of the home, stay recommended distancing. 
    3. Inspectors can continue to do business at this time.
  3. APPRAISALS: In person
    1. Appraisals can be set further out based on seller preferences
    2. If Sellers are uncomfortable leaving the home, then consult with them about option to ensure CDC best practices. Options could be, but not limited to: go outside, go in another area of the home, stay recommended distancing. 
    3. Appraisals can continue to do business at this time.
  4. MOVERS:  Movers are allowed to conduct business.
  5. NEW CONSTRUCTION:  Contractors are allowed to conduct business.
  6. CLOSINGS:  Will be able to continue.  Only Buyer and Seller will attend. All materials will be exchanged electronically. 
    1. Files are being prepared and finalized electronically. 
    2. Earnest money checks are delivered to title company.
    3. Check for items that need to be completed and review with your buyer and seller.
    4. Confirm that the contract coversheet is up to date and commission or any payments out of commission are correct.  Referrals, team changes, charges or payments to other parties.
    5. Files electronically sent to title company.
    6. Closing takes place.

The Director of the Columbia/Boone County Public Health and Human Services just issued Stay at Home Orders for the City of Columbia and Boone County (City Stay at Home Order …  Boone County Stay at Home Order) to go into effect at 8:00 a.m. tomorrow, March 25th and end at 8:00 a.m. on April 24th (these orders can be superseded or extended at any time).  The Orders for the City and County are essentially the same Order, but differ in Section 4.02 Enforcement.  According to the orders, "non-essential business and operations must cease" unless deemed an essential business.  The following are listed as "essential business" that are related to the real estate industry and can continue to operate under the Orders.    

 

F. "Essential Businesses" means, with the exception of Disqualified Businesses, the following:…

 

10. banks, financial institutions, broker-dealers, asset managers, businesses that process payroll for any other business, and businesses that process financial transactions and services;…

 

14. plumbers, electricians, exterminators, and other service providers who provide services that are necessary to maintaining the safety, sanitation, communication, and essential operations of Residences, Healthcare Operations, Essential Critical Infrastructure, Essential Government Services, Essential Activities, or other Essential Businesses;

 

15. businesses that perform construction services;…

 

35. professional services, such as legal services, accounting services, insurance services, real estate services (including appraisal, mortgage and title services) or financial services, when necessary to assist in compliance with legally mandated activities or to assist a person in the exercise of constitutional rights, including but not limited to services required by a court order, a court rule, a fiduciary duty, a duty to the person's client, or an ethical obligation;

 

Other Essential Businesses unrelated to the real estate industry of note include:

 

4. grocery stores, farmers' markets, farm stands, produce stands, supermarkets, food banks, food pantries, convenience stores, or other establishments engaged in the retail sale of or providing canned food, dry goods, fruits, vegetables, pet supply, meats, fish, and poultry, or any household consumer products ( e.g., cleaning or personal care products), including but not limited to stores that sell groceries and also sell other non-grocery products, and products necessary to maintaining the safety, sanitation, and essential operation of Residences; however, no dine in service is permitted;…

 

9. gas stations, auto-supply, auto-repair, and related facilities;…

 

12. hardware stores;…

 

21. churches, religious services, and other spiritual practices but only to the extent consistent with reasonable compliance with Social Distancing Requirements and gathering size limitations;…

 

23. restaurants and other facilities that prepare or serve food; however, only carry out, pick-up or delivery service of such food is permitted and Social Distancing Requirements must be met (ie., no dine-in service is allowed). Self-service food or self-service condiments are expressly prohibited in any restaurant or facility that prepares or serves food with the sole exception of self-serve fountain drinks served in a new unused disposable cup;

 

 

You are permitted to leave your home to perform essential activities which include items related to "specifically related to health and safety, the procurement of necessary supplies and services, for outdoor activity, for certain types of work and to care for others. When engaging in any outdoor activity, individuals must comply with Social Distancing Requirements."

 

E. "Essential Activities" means activities that are necessary for a person to:

 

1. act or perform tasks essential to any person's health and safety, or to the health and safety of their family, household members, or pets, including but not limited to obtaining medical supplies or medication, visiting a health care professional, obtaining supplies needed to work from home, or laundering clothing;

 

2. obtain Necessary Services or Supplies for themselves and their family, household members, or pets, or to deliver Necessary Services or Supplies to others;

 

3. engage in Essential Travel;

 

4. shop for grocery products, food, beverages, or other household and consumer products (for example, cleaning or personal care products including but not limited to products necessary to maintain the safety, sanitation, communication, and the essential operation of Residences);

 

5. engage in services or perform work necessary to operate or maintain Essential Critical Infrastructure;

 

6. engage in outdoor activity (including walking, hiking, running, or biking) to the extent reasonably consistent with Social Distancing Requirements (including, for example, walking outdoors six feet away from another person);

 

7. participate in religious services and other spiritual practices but only to the extent consistent with reasonable compliance with Social Distancing Requirements and gathering size limitations;

8. acts consisting of providing Essential Products and Services to a Residence, an Essential Business, or to a business in order for that business to maintain Minimum Basic Operations;

 

9. activities at open construction sites, irrespective of types of structures, subject to applicable OSHA and other safety guidelines, and related architectural, design, and land surveying activities, so long as the people involved reasonably comply with Social Distancing Requirements to the extent consistent with applicable safety guidelines;

 

10. necessary care for a dependent in the person's legal custody, including acts essential for a parent with legal custody to transfer the physical custody of a child;

 

11. care for a family member in another household;

 

12. engage in Essential Government Functions;

 

13. engage in Healthcare Operations;

 

14. engage in Essential Businesses;

 

15. exercise constitutional rights to the extent that by so acting the person does not endanger the public health and safety or the health and safety of any person;

 

16. acts consisting of providing Essential Products and Services to the federal government, the state government, or other political subdivision of the state of Missouri;

 

Enforcement of Stay Home Order

 

"Violation of or failure to comply with this Order is a crime punishable by fine, imprisonment, or both..." City of Columbia Order

New COVID Forms from Missouri Realtors

Dear Members,

 The current world-wide Coronavirus pandemic ("COVID-19") has had unprecedented impacts on real estate transactions.  In order to help you address some of these issues, the Missouri REALTORS® Residential Forms & Risk Management Mission Committees have held emergency meetings this week to develop and approve two new forms for your use:

 COVID-19 RIDER / AMENDMENT

~ This form is designed to work as both an Amendment (for existing Sale Contracts), as well as a Rider (for new offers).

~ Box 1 allows for the parties to elect to extend the Closing Date (only) and will likely be used in existing Contract situations.

~ For situations in which parties to an existing Contract will not agree to an extension of any kind, the parties should just complete a Mutual Release (MSC-4050) per usual. 

~ Box 2 is designed to effectively extend the date of ALL remaining contingencies which have not yet expired under the Contract (as agreed upon b/w the parties) with 30 days as a default.    

 ~ An extension is provided even for a voluntary quarantine (by either Buyer or Seller). If parties are concerned that such an extension could be abused, they may choose to insert additional language requiring the party claiming the need to first provide a note from a health care professional documenting the need to self- quarantine.  We thought this too much to try to include in this form.

~ Section 4 can be used to alter any of the above or to set forth any other terms and conditions agreed to by the parties.

 LISTING CONTRACT COVID-19 RIDER /AMENDMENT

~ This form is designed to document an Owner's decision to allow (or not) continued open houses, "in-person" (live) showings, and continued access to a Property by potential buyers, buyer's agents, inspectors, appraisers, contractors, and others as may be necessary to complete the sale and closing of the Property.

~ It too is designed to work as both an Amendment (for existing Listing Contracts), as well as a Rider (for new listings).

 Our work is not yet done.  We remain committed to providing our members all of the tools and information needed to navigate these trying times.  We will proceed to process these forms and make them available via all of our vendors (per usual), but in order to avoid delay, they are attached to this message and available for your immediate use.

Next Week Events Schedule and Changes

Happy Friday!

Next week we had planned some fun and informative training and sessions to celebrate what we were calling "Awards Week".  As companies in Columbia are making decisions on how to handle larger group gatherings, we need to do the same. We want to be smart, safe and keep everyone healthy. We are going to rework the office events next week for some fun online events vs. in person. 

 

  1. Monday – 10:00-10:30am Photo Shoot or Photo Sh*t?  Join us on Facebook live in the RBR Agents Facebook Group.  We are excited to announce that Chris Jansen will be our preferred company photographer including discounts, full photo solutions including Matterport, drone, and more – exclusively available to RE/MAX.  He has established a team to service your requests within 24 hours (if needed).  He will show you differences in photography techniques, lighting and camera lens.  He will also provide lifestyle shoots for agents so you have more options to market yourself.  Watch online live or the video at your leisure.   1. Tuesday – 11:00am Commerce Bank Investing in your Future. CANCELLED. We will reschedule the full session for a later date.

Thursday RED Awards and Recognition Banquet – In lieu of the event, we will have a "Social Celebration" online.  We are cancelling the event at Old Hawthorne and will look forward to when we can celebrate together again "Cornonavirus Free".  HOWEVER, we will be posting videos, and pictures in our company group and online to celebrate the individual and company accomplishments for 2019.  Keep an eye on our social pages and don't be surprised if you get tagged 😊

Coronavirus and Real Estate

Hi Everyone,

 

Each new day ends up with new information about the coronavirus and how it is affecting our day-to-day lives. Undoubtably, one of the questions is how is it impacting the real estate industry. As the virus arrives in Missouri we all have questions and concerns on how it will impact the next few months, if not even longer.  The one thing that will continue to happen is we will have buyers that are going to need/want to buy and sellers that are going to need/want to sell. It will be incumbent on us to be the professional who can remain by their side and find innovative and creative ways to continue to make that happen. Fortunately we have several tools and resources to transact real estate virtually or so here are some ways to make sure that we can continue to service our clients.

 

3 QUESTIONS TO ASK EVERYONE (buyers, sellers, inspectors, closing agents, mortgage, etc.):

  1. Have you traveled recently and particularly to areas identified to have an increased risk of coronavirus?
  2. Do you have any signs of respiratory illness?
  3. Will you please let me know at any time if your answers change?

 

STAY HEALTH AND SMART

The same preventative measures recommended to prevent influenza are also effective in reducing the risk of contracting or spreading coronavirus.  These measures include:

 

  • Staying home if you have a fever, cough, shortness of breath or any other cold or flu-like symptom.
  • Washing your hands frequently with soap and water for at least 20 seconds. If soap and water aren’t available, use an alcohol-based hand sanitizer.
  • Avoiding touching your eyes, nose, and mouth with unwashed hands.
  • Avoiding close contact with anyone who is sick.
  • Cleaning and disinfecting frequently touched objects and surfaces.
  • Covering your mouth and nose with a tissue when you cough or sneeze, or cough or sneeze into your sleeve.

 

Be sure to refer to the CDC’s website for up-to-date information about travel warnings(link is external), as well as information about the coronavirus’ current impact in the United States(link is external). Daily updates about the coronavirus are also available from the World Health Organization(link is external).

 

Q. What unique issues does coronavirus present to the real estate industry?

A. When an infectious disease, such as coronavirus, is associated with a specific population or nationality, fear and anxiety may lead to social stigma and potential discrimination. REALTORS® must be mindful of their obligations under the Fair Housing Act, and be sure not to discriminate against any particular segment of the population. While the coronavirus outbreak began in Wuhan, China, that does not provide a basis for treating Chinese persons or persons of Asian descent differently.

 

Q. May I ask clients or others I interact with in my real estate business if they have traveled recently, or have any signs of respiratory illness?

A. Yes, you may ask clients or others about their recent travel, particularly to areas identified as having an increased risk of coronavirus. To avoid potential fair housing issues, be sure to ask all clients the same screening questions based on current, factual information from public health authorities. If you are uncomfortable working with someone based on their answer, please make note of why.  You can certainly suggest that you hold off their property search until they are tested or sure they are not contagious. 

*note – this also applies to anyone who may enter a home or you would be in contact with.

 

Q. I typically drive my clients to showings. May I refuse to drive potential clients to see homes?

A. Yes. However, be sure that any change to your business practices is applied equally to all clients. You may refuse to drive clients who show signs of illness or reveal recent travel to areas of increased risk of coronavirus, or you may instead decide to stop driving clients in your car altogether, and simply arrange to meet clients at a property. If you do continue to drive clients in your car, it is a good idea to frequently clean and disinfect surfaces like door handles and seat belt latches, and to ask clients to use hand sanitizer when getting in and out of the car.

 

MARKETING AND SHOWINGS

 

Q. Should I still conduct open houses on my listed properties?

A. Speak openly and honestly with your seller about the pros and cons of holding an open house. Assess the risk based on your specific location, and direct your clients to local and state health authorities for specific information about the severity of the risk in your area. You could also propose alternative marketing opportunities for your seller’s consideration, such as video tours and other methods to virtually tour a property. If you do hold an open house, consider requiring all visitors to disinfect their hands upon entering the home, and provide alcohol-based hand sanitizers at the entryway, as well as soap and disposable towels in bathrooms. If you decide to do any cleaning at your client’s home, be sure to check with your client in advance about any products you plan to use. After the open house, recommend that your client clean and disinfect their home, especially commonly touched areas like doorknobs and faucet handles.

 

Q. How can I conduct virtual showings?

A.  If you have a listing or you are going to list a home take extra pictures, hire a professional to do a virtual tour, film a video of the house and of specific rooms and the neighborhood.  Take special care to do this early. You want to have as much digital media on the property incase your entry is limited to the home later on.  Buyers may not want to enter and sellers may not want people come into the home.  If you still have access to the home, but buyers don’t want to enter, you can tour the home virtually with a video call.  You could even walk someone thru the home while they wait outside in their car as they direct you to enter and scan rooms.  Should the seller not be comfortable with buying agents entering the home, listings agents can conduct the showings or you can help sellers conduct the showings.  Ask them if they know how to do a video call or help them learn how to use their home.

 

Q. What else?

A. Make sure you focus on regular communication.  Use video and send pictures to be more relatable.  People love to see others smile.  Clients are bound to have more uncertainly and fear with all of the news and updates.  Make sure you are talking with them regularly and sharing market updates.  Connect with your sphere and see if they need anything.  A lot of the fear right now is that people are isolated and may be unsure of how they can get help in a crisis.  They may feel alone especially if they don’t have family in the area.  Reach out to your clients and let them know that you are a resource for their concerns and what is happening in the community.  You know where they live and can help them if necessary. 

 

CLOSINGS AND CONTRACTS

 

Q. What if someone can’t attend closing because of a quarantine or sickness?

A.  We have many measures to continue business electronically to facilitate the closing of properties if someone cannot attend.  Be in touch with your closing/lending agents on how to deliver documents electronically or simply dropped/picked up on a front porch.  We also have some sample language we can add to a contract if this happens.  We may need to facilitate alternative closing dates, possession after closing or other ideas.  We are creative and innovative to solve these situations, but we will need to be proactive, increase our communication and stay up on our paperwork. 

 

Q. Are their other reasons this may impact my contracts?

A. We may not be able to conduct the inspection if someone if quarantined.  We might need to adjust inspection and closing dates accordingly.  Time will solve this situation, we may just need our clients to be patient. 

 

Q. What will this do to the market?

A. Sellers may hold off listing their property.  With inventory so low, this may cause even more demand and multiple offers.  It could be a great time for someone to list their property when the demand will be high.  Please continue provide A Buyers and Sellers Guide to Multiple Offers to your clients.  We also have an escalation form for offers.  Please contact us if you need this document.  I anticipate we may see a lull in the upper end.  Traditionally when the stock market suffers we see the upper end have more reservation about selling and buying.  This is a great time to invest in real estate and review investment portfolios.  Talk with your clients about low rates and real estate as a more stable investment. Buyers could be hesitant to move.  It may be a slower year.  However we may see a burst this summer as things sort out and we may have a summer rush so be in touch with your clients to help advise them accordingly.
